Senate Legislation Would Aid Compliance with Medicaid Work Requirement

Healthy Michigan Plan logoOn June 5, Senate Majority Leader Mike Shirkey (R-Clark Lake) and Sen. Curtis Hertel (D-East Lansing) introduced a pair of bills that would amend the Medicaid work requirement legislation signed into law by Gov. Rick Snyder in 2018. Senate Bills (SBs) 362 and 363 seek to ease the difficulty of work requirement compliance for Healthy Michigan Plan Medicaid recipients, a key focus of the MHA’s advocacy efforts.

SB 362 would amend the deadline for Healthy Michigan Plan recipients to meet the workforce engagement reporting requirements. Under existing statute, enrollees receiving Medicaid benefits would have until the 10th day of each month to report their compliance for the previous month. SB 362 would extend that reporting deadline to the end of the month, as well as allow for retroactive verification of compliance. This would mean that months in which reporting does not occur would not be counted as noncompliant as long as the Michigan Department of Health and Human Services (MDHHS) is provided with documentation at a later date.

SB 363 would establish a reporting exemption for Medicaid recipients enrolled in the Healthy Michigan Plan if the MDHHS is able to verify the recipient’s compliance through other available data. This would allow the MDHHS to coordinate with the Department of Treasury to use routinely provided tax information to verify work requirement compliance.
