U.S. House Passes Legislation to Combat Opioid Addiction Epidemic

Michigan's opioid epidemicOn June 22, the U.S. House of Representatives passed H.R. 6, an omnibus package of legislation to address the opioid drug addiction crisis. The House Energy and Commerce Committee published a summary of the package at its website dedicated to the opioid issue.

Two stand-alone bills have a direct impact on MHA members.

  • H.R. 5797, as amended, would allow states to receive federal matching funds for up to 30 days per year for services provided to adult Medicaid beneficiaries with an opioid use disorder in an institution for mental disease (IMD) and expands treatment coverage to individuals suffering from cocaine use disorder. Michigan has been using Medicaid funds for IMDs, but federal approval was at risk during the adoption of the Healthy Michigan Plan; this legislation would ensure Medicaid matching funds for these IMD services.
  • H.R. 6082 would align 42 CFR Part 2 regulations (part of the Code of Federal Regulations) with the Health Insurance Portability and Accountability Act to allow healthcare providers to responsibly share substance use disorder (SUD) treatment information. Limits on sharing SUD treatment details have kept that information out of the medical record, hindering caregivers treating patients who have experienced SUD.

All three bills are now in the U.S. Senate, which also has its own set of bills to address the opioid problem. The House and Senate must reconcile their packages before any of these provisions will become law. For more information, contact Laura Appel at the MHA.
